Terms of Service

1. Agreement to terms
By creating an account on Harvu ("Harvu", "we", "us", or "our") you agree to these Terms of Service ("Terms"). If you do not agree, do not use Harvu.
If you are under 18, a parent or guardian must review and consent to these Terms on your behalf before your account is activated. If you are under 13, you may not use Harvu under any circumstances.
2. Who can use Harvu
2.1 Age requirements
You must be at least 13 years old to use Harvu.
If you are between 13 and 15 years old (or under the digital age of consent in your country), you may only use Harvu after a parent or guardian has given verified consent through our parental consent process.
Users under 13 years old are prohibited from using Harvu. Accounts found to belong to users under 13 will be immediately terminated and all data deleted.
2.2 Account registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may not create an account on behalf of another person without their authorisation, except that coaches may invite players through the invitation system.
2.3 One account per person
Each person may maintain only one account. Creating multiple accounts to circumvent restrictions or suspensions is prohibited.
3. User roles
3.1 Coaches
Coaches are the primary paying users of Harvu. As a coach you may:
- Create and manage a player roster
- Log session notes and summaries
- Upload voice recordings and video
- Generate AI session summaries
- Set goals for players
- Share session content with players
- Enable parent access for players
- Book and manage training facilities
- Organise group sessions
- Build a personal drill library
Coaches are responsible for the accuracy of session records they create. Harvu is a documentation tool — the coaching judgment and all content is always yours.
3.2 Players
Players have free accounts connected to their coach. As a player you may:
- View session summaries your coach has shared with you
- View your training calendar
- View goals set by your coach
- Access your development journal
- View private videos shared by your coach
Players cannot edit session content created by coaches.
3.3 Parents
Parents may access monthly development reports for their child through the parent add-on ($4.99 per player per month), purchased through the coach's Pro plan. Parent access is controlled by the coach.
4. Coach responsibilities
4.1 Professional conduct
As a coach using Harvu you agree to:
- Only invite players you have a genuine coaching relationship with
- Create session records that are honest, constructive, and appropriate
- Not share session content that is defamatory, harmful, or inappropriate for the player's age
- Treat player data with the confidentiality expected in a professional coaching relationship
4.2 Minor players
When working with players under 18 you agree to:
- Ensure a parent or guardian has been made aware before inviting a minor player to your roster
- Not share inappropriate content with minor players
- Maintain appropriate professional boundaries in all communications
- Comply with all applicable laws regarding working with minors in your jurisdiction
4.3 Content standards
All session notes, voice recordings, videos, and other content you upload must:
- Relate to the coaching relationship
- Be appropriate for the player who will see it
- Not contain personal attacks, discriminatory language, or content that could harm the player
- Comply with all applicable laws
5. Content and intellectual property
5.1 Your content
You retain ownership of all content you create on Harvu including session notes, recordings, and videos ("Your Content").
By uploading content to Harvu you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the service to you and the users you choose to share it with.
We do not claim ownership of Your Content. We do not use Your Content to train AI models. We do not share Your Content with any third party except as described in our Privacy Policy.
5.2 AI-generated summaries
Session summaries generated by our AI are based on your input and are provided as a documentation aid. You are responsible for reviewing and approving AI-generated content before sharing it with players. The AI summarises what you documented — it does not provide independent coaching assessments or recommendations. Harvu makes no warranty about the accuracy of AI summaries.
5.3 Harvu's intellectual property
Harvu and its original content, features, and functionality are owned by Harvu and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our platform or its content.
6. Prohibited uses
You may not use Harvu to:
- Harass, bully, or threaten any user, particularly minors
- Share sexually explicit, violent, or harmful content
- Impersonate another coach, player, or any person
- Collect or harvest personal information about other users
- Circumvent age verification or parental consent systems
- Use the platform for commercial purposes beyond your coaching practice
- Attempt to access, tamper with, or disrupt our systems or other users' accounts
- Upload content that infringes a third party's intellectual property
- Use the service for any illegal purpose
- Create accounts for users you do not have a coaching relationship with
Violations may result in immediate account termination without refund.
7. Payment and subscriptions
7.1 Free plan
The Free plan is available at no cost and includes up to 2 active players and 10 sessions per month. We reserve the right to modify free plan limits with 30 days' notice.
7.2 Pro plan
The Pro plan is billed monthly at the rate displayed at the time of purchase. Billing is handled by Stripe. Your subscription renews automatically each month unless cancelled.
7.3 Parent add-on
The parent add-on is $4.99 per player per month, billed to the coach's account. The coach controls whether parent access is enabled for each player.
7.4 Cancellation
You may cancel your subscription at any time through your billing settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
7.5 Price changes
We will give 30 days' written notice of any price changes. Continuing to use Harvu after the effective date of a price change constitutes acceptance.
7.6 Failed payments
If payment fails your account will be downgraded to the Free plan after a 7-day grace period. Your data will not be deleted during this period.
8. Privacy and data
Your use of Harvu is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms you also agree to our Privacy Policy.
9. Disclaimers
9.1 Not a coaching service
Harvu is a documentation and communication tool for coaches. We are not a coaching service and we do not provide coaching advice. The AI features in Harvu are documentation aids only — they summarise what the coach documented and do not provide independent coaching assessments or recommendations.
9.2 No warranty
Harvu is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted or error-free, that AI-generated summaries will be accurate or complete, or that the service will meet your specific requirements.
9.3 Third-party services
We are not responsible for the actions or content of third-party services including Stripe, Deepgram, Anthropic, Supabase, or Resend.
10. Limitation of liability
To the maximum extent permitted by law, Harvu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the greater of: (a) the amount you paid to Harvu in the 12 months preceding the claim, or (b) $100 CAD.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Harvu and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, your violation of any third party's rights, or content you submit to the service.
12. Termination
12.1 Termination by you
You may delete your account at any time through your account settings. Upon deletion your data will be removed within 30 days subject to our data retention obligations.
12.2 Termination by us
We may suspend or terminate your account immediately if you violate these Terms, engage in conduct harmful to other users (particularly minors), provide false information during registration, or fail to pay fees owed. We will provide notice where reasonably possible unless immediate termination is necessary to protect users or the platform.
12.3 Effect of termination
Upon termination your access to the service will cease immediately. Session data shared with players before termination may remain visible to those players until they delete their accounts. We will delete your data within 30 days subject to legal retention requirements.
13. Governing law and disputes
These Terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.
For EU/EEA users: nothing in these Terms removes your rights under EU consumer protection law or your right to bring claims before your local courts.
For UK users: you retain all rights under UK consumer protection legislation.
We encourage you to contact us at team@harvu.app before initiating any formal dispute. We will make good faith efforts to resolve issues informally first.
14. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. For users under 18, we will notify the parent or guardian on file. Your continued use after the effective date constitutes acceptance of the updated Terms.
15. Miscellaneous
Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Harvu.
Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
No waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights in connection with a merger or acquisition.
